Ovation's Enchanted Occasions res​erves the right to change or modify any of the terms and conditions contained in the Terms and Conditions from time to time at any time, without notice, and in its sole discretion. If Ovation's Enchanted Occasions decides to change these Terms and Conditions, Ovation's Enchanted Occasions will post a new version on the site and update the date set forth above. Any changes or modifications to these Terms and Conditions will be effective upon posting of the revisions. Your continued use of the sites following posting of any changes or modifications constitutes your acceptance of such changes or modifications and if you do not agree with these changes or modifications, you must immediately cancel all scheduled services with Ovation's Enchanted Occasions and cease using the site. For this reason, you should frequently review these Terms and Conditions and any other applicable policies, including their dates, to understand the terms and conditions that apply to your use of the site and Ovation's Enchanted Occasions services.

 

 

 

 

 

 

 

Clients of Ovation's Enchanted Occasions through Ovation Studio for the Performing Arts are bound to all terms and conditions listed below:

 

Clients will first submit a service form for their desired service, Ovation's Enchanted Occasions will schedule desired character(s) and assistant (if an assistant is required for the service), once performers and assistants have been scheduled clients will pay required deposit and submit a client contract. Service will not be secured until deposit via Ovation Studio for the Performing Arts Venmo and contract has been received. 

 

Covid Protocols 

 

 

 

 

 

Clients acknowledge that Ovation's Enchanted Occasions cannot guarantee that they will not become infected with the Coronavirus/Covid-19. They understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, contractors, employees, and other Ovation's Enchanted Occasions clients and their families.

 

 

Performers/assistants may wear transparent/clear face masks at their discretion provided by Ovation's Enchanted Occasions. Assistants will wear latex gloves provided by Ovation's Enchanted Occasions. Performers will wear gloves that are associated with the character they are portraying or latex gloves provided by Ovation's Enchanted Occasions during character activities.

 

 

Clients must provide performers a space to perform that is 6 feet from all individuals so they can perform mask free if requested.

 

 

Before activities begin all participants must use hand sanitizer in between every activity where items are touched. Ovation's Enchanted Occasions will provide a bottle of hand sanitizer and assistants will dispense it.

Ovation's Enchanted Occasions requests that services are scheduled two weeks in advance, services maybe accommodated with less then two weeks notice if requested character performers are available.

Service Forms

 

 

 

 

 

Service forms can be found on each service page. Clients must fill out service form to the best of their ability to finalize scheduling service with Ovation's Enchanted Occasions.

 

 

Deposits, Remaining Balance, Refunds, And Payment Plan

 

 

 

 

Once Ovation's Enchanted Occasions schedules performers and assistants for a service clients must submit the required deposit amount  for their desired service via Ovation Studio for the Performing Venmo in order to secure service. All deposits are non refundable.

 

 

 

Remaining balance must be paid the day of service before the service begins (if full payment isn't required at time of scheduling), if balance isn't received on time service will be immediately canceled.

 

 

 

If a remaining balance is paid and service needs to be canceled balance total will be refunded (not including non refundable deposit). If client would like to reschedule a service the client must pay a second non refundable deposit to secure the character performer and assistant for new date and time. 

 

 

 

Ovation's Enchanted Occasions doesn't offer payment plans at this time. 

 

 

 

Safety Of Character Performers And Assistants 

 

 

 

Verbal, physical, sexual harassment, violence, fighting, weapons, and verbal or physical abuse is never acceptable and is grounds for immediate cancelation of a service. 

 

Liability​

 

 

 

Clients and all guests (including parents of minors) will waive, release, absolve indefinitely and agree to hold harmless the organizers, sponsors, supervisors, participants and persons involved in the operation of Ovation's Enchanted Occasions for any claims arising out of injury or other loss/damage to personal property before/during/after services are provided. 

 

Clients additionally agree to indemnify the independent owner of Ovation's Enchanted Occasions, their predecessors, parent, subsidiaries and affiliates, officers, and employees for any defense cost or expense arising from any and all claims, injuries, liabilities or damages arising from participation, except for those arising from the gross negligence or willful misconduct of Ovation's Enchanted Occasions.

 

Photo Release

 

 

 

Clients and all guests (including parents of minors) will grant and authorize Ovation's Enchanted Occasions the right to take, edit, alter, copy, exhibit, publish, distribute and make use of any and all pictures and videos taken during provided services. Materials to be used in and/or for legally promotional materials including, but not limited to newsletters, flyers, posters, brochures, advertisements, fundraising letters, annual reports, press kits and submissions to journalists, websites, or any other consideration. This authorization extends to all languages, media, formats and markets now known or hereafter devised. This authorization shall continue indefinitely. I understand and agree that these materials shall become the property of Ovation Studio for the Performing Arts.

 

 

 

 

 

Photo Acknowledgment 

 

 

 

 

 

 

 

Clients and/or guests participating in services acknowledge all pictures and videos taken on personal devices are for personal use only. All individuals hereby agree to never sell any photos or videos to anyone unless they have written consent from Ovarion's Enchanted Occasions. 

 

Virtual Meet And Greet, Recorded Personal Messages

 

 

All videos recorded/created by Ovation's Enchanted Occasions are owned by Ovation's Enchanted Occasions. The fee that a client pays to order a video is a license to view, download, and share that video. The ownership of the video belongs to Ovation's Enchanted Occasions. No one can sell or profit from any videos without the express agreement and permission of Ovation's Enchanted Occasions. You must not modify any materials in any way. 

 

 

 

 

 

Non Disclosure

 

 

 

 

 

 

 

I am not affiliated with a competitor of Ovation's Enchanted Occasions (including but not limited to owner, employee, or contractor of a competitor). I am not acting on behalf of a Ovation's Enchanted Occasions competitor and will not use the Ovation's Enchanted Occasions performance or correspondence to give any information, video, or photographs to a Ovation's Enchanted Occasions competitor.

 

Service Agreements

 

 

 

 

Clients agree that Ovation's Enchanted Occasions will be the only entertainment provided during requested service. Any other entertainment will be scheduled before or after. 

 

 

 

Clients will not hire character performers from other companies to appear during Ovation's Enchanted Occasions services.

 

 

Clients agree to not charge anyone fees of any kind during services provided by Ovation's Enchanted Occasions to photograph/videotape, interact, or see character performers unless they obtain permission first from Ovation's Enchanted Occasions.

 

 

 

Clients agree to abide by the time frame set when service is secured. Clients and guest won't delay a character performers start time or departure. If a service goes over set time clients will receive an invoice and agree to pay for additional time. If a character performer is running late or needs to take a break during a provided service that time will be added to the end of the service so the client receives the full amount of time the client has paid for. Clients agree that if any delays or distractions take place during a provided service some requested character activities may be missed due to time constraints. 

 

 

 

 

 

Behavior

 

 

     

 

 

Clients agree to be present at all times during provided services to handle any disruptive behavior that may arise.

 

Clients assume responsibility for all minors who aren't accompanied by a parent and will address any safety or behavior issues.  

 

Tips

                            

 

 

Tips will never be asked for or expected, although they are greatly appreciated as preparing for services can be very time intensive.

 

Property Damage Policy

                                          

 

 

Clients agree that they will be responsible for any damage to character performers costume (including but not limited to wigs, shoes, clothing, and accessories), character activity materials, or other items that are property of Ovation's Enchanted Occasions caused by any service participants. I will avoid staining agents (including but not limited to foods and craft supplies) before and during the character performers time at the provided service. Ovation's Enchanted Occasions suggests that no food or drink be consumed during the set provided service time and before the first character activity begins all participants must wash their hands with soap and water and then use hand sanitizer in between every character activity thereafter. 

 

 

 

 

Clients agree to keep all pets out of the event area and out of any pathways Ovation's Enchanted Occasions character performers or assistants may take. Clients understand they may be held responsible for any damage done to costumes or other property of Ovation's Enchanted Occasions due to pets. 

 

 

 

 

Outdoor Service Locations

 

 

 

                                                                                    

 

 

Location must be totally dry. 

 

 

 

Safe flat performance space for the character performer.

 

 

 

Shade to keep character performer out of direct sunlight would be greatly appreciated.

 

 

 

Should a character performer get to hot and needs to take a break during a provided service that time will be added to the end of the service so the client receives the full amount of time the client has paid for. 

 

 

 

 

Bad Weather Policy

 

 

 

If rain/snow/wet weather impede providing a service outside a backup indoor location must be available. 

 

 

 

 

Travel and Parking

 

 

 

Travel expenses will be added to service totals when travel time exceeds 30 minutes for character performers and assistants.

 

 

 

If a character performer is running late we will contact the client immediately and that time will be added to the end of the service so the client receives the full amount of time client has paid for.

 

 

 

 

Clients agree to pay for any parking fees that maybe acquired. 

 

Termination

 

 

Ovation's Enchanted Occasions reserves the right to cease providing services at any time.

 

 

 

 

Ovation's Enchanted Occasions shall not be liable to you for any cost, expense, or damages whatsoever for terminating this Agreement.

 

Governing Law

 

 

Any claim relating to ovationsenchantedoccasions.com's website shall be governed by the laws of the State of Colorado without regard to its conflict of law provisions.

 

 

 

 

The client is of physical ability to participate and am legally competent to understand and complete this agreement. They hereby execute this agreement without coercion.
